Dear customer, Thank you for your interest in this vehicle. According to a specification of Volkswagen AG, we as the seller are obliged to inform you of the following facts with regard to this vehicle before the conclusion of the purchase contract. Diesel vehicles currently have a function in which the exhaust gas recirculation rate is gradually reduced/adjusted outside a certain temperature range (“thermo window”). The exhaust gas recirculation rate for diesel vehicles is also gradually reduced in relation to the height of the vehicle above sea level (\"altitude correction\"). In addition, there is a function in a number of diesel vehicles that causes the exhaust gas recirculation to be completely shut down after the engine has been running continuously for several minutes when idling (“taxi switch”). According to the previous administrative practice of the responsible type approval authorities, including the German Federal Motor Transport Authority (KBA), \"thermal windows\" are legally permissible if they serve to protect against sudden, unforeseeable damage to the vehicle\'s engine and to ensure safe operation of the vehicle . This also applies to the admissibility of controlling the exhaust gas recirculation in connection with the altitude correction and the so-called \"taxi circuit\". This previous administrative practice corresponds to the requirements of the legislator and the previous court decisions at European level. In several judgments of July 14, 2022 and November 8, 2022, the European Court of Justice supplemented the previous European case law. According to this, under certain conditions, thermal windows can also represent an impermissible switch-off device if they serve to protect the motor. This applies even if the responsible type-approval authority has approved the respective thermal window according to the specifications applicable up to that point. In proceedings brought against the KBA on February 20th, 2023, the VG Schleswig ruled that the thermal window of a VW Golf+ with an EA189 engine to be assessed in these proceedings, as well as the height correction and the taxi circuit, do not meet the criteria of the European Court of Justice for engine protection. The verdict is not yet legally binding. Against the background of this new development in European case law, it cannot be ruled out that in the future authorities and courts will assess the specific design of individual thermal windows, the admissibility of the control of exhaust gas recirculation in connection with the altitude correction and the taxi circuit as not permissible.
