Thank you for your interest in this vehicle.
In accordance with a requirement of AUDI AG, we are obliged to inform you of the following facts before concluding the purchase contract. This concerns the models mentioned here:
A4, A5, A6, A7, A8, Q5 and Q7 of the model years 2003 to 2012.
With a V6 TDI EURO 3 - / EURO 4 - / EURO 5 - engine.
According to industry-wide standard, diesel vehicles from all manufacturers currently available for purchase have a so-called thermal window. This is a function whereby outside a certain temperature range the exhaust gas recirculation rate is gradually reduced or completely shut down.
According to the administrative practice of the European type-approval authorities, including the Federal Motor Transport Authority, thermal windows are legally permissible if they serve to protect against sudden, unforeseeable damage to the vehicle's engine and to ensure the safe operation of the vehicle. This administrative practice complies with the requirements of the legislator and the judicial decisions at European level.
On 14 July 2022, the European Court of Justice issued three new rulings, supplementing the previous European case law. According to these new rulings, thermal windows can, under certain conditions, also constitute an impermissible defeat device if they serve to protect the engine. This applies even if the responsible type-approval authority had tested and approved the respective thermal window according to the previously valid specifications.
Therefore, we would like to inform our customers before they purchase vehicles with possibly comparable thermal windows:
Against the background of this new development in European case law, it cannot be completely ruled out that in future authorities and courts could assess the specific design of individual thermal windows as not permissible. This cannot be ruled out with regard to the thermo window that is present in the vehicle you are interested in. In this case, it cannot be ruled out with certainty that the manufacturer will issue recalls or that the authorities will order recalls or other measures, including against vehicle owners. This could go as far as a withdrawal of the vehicle registration or a prohibition of use directed against vehicle owners. Possible effects on the resale value of the vehicles cannot be ruled out in such a case either.
In the event that a thermo window used in its specific design is classified as not permissible in the future and recalls are issued, AUD AG will develop suitable technical solutions and make them available to all owners of the affected vehicles free of charge or provide other remedies.
